Consultation on temporary residence for foreigners.

A temporary residence card is a document issued by the immigration management agency or an authorized agency of the Ministry of Foreign Affairs to foreigners who are allowed to reside in Vietnam for a specified period. It can also serve as a replacement for a visa.

Below is a list of individuals eligible for a temporary residence card, along with the type of card and specific validity period.

3 Foreigners who come to work with socio-political organizations, social organizations, or the Vietnam Chamber of Commerce and Industry. LV2 Up to 5 years.
4 Foreign investors in Vietnam and foreign lawyers practicing in Vietnam. ĐT Up to 5 years.
5 Foreigners coming to Vietnam for internships or studies. DH Up to 5 years.
6 Foreigners who are Heads of representative offices or projects of international organizations or foreign non-governmental organizations in Vietnam. NN1 Up to 3 years.
7 Foreigners who are heads of representative offices, branches of foreign traders, representative offices of economic, cultural, or other professional organizations in Vietnam. NN2 Up to 3 years.
8 Resident reporters and journalists in Vietnam. PV1 Up to 2 years.
9 Foreigners entering Vietnam for work, who have a work permit and are currently employed by various types of businesses or representative offices of foreign companies. Up to 2 years.
10 Foreigners who are spouses or children under 18 of foreigners holding visas with codes LV1, LV2, ĐT, NN1, NN2, DH, PV1, LĐ, or foreigners who are parents, spouses, or children of Vietnamese citizens. TT Up to 3 years.
Conditions

for issuing a temporary residence card to foreigners.

To apply for a temporary residence card in Vietnam, foreigners must meet the following conditions:

- A passport with at least 13 months of remaining validity (If the passport has 13 months of validity left, the Immigration Department will issue a temporary residence card with a maximum validity of 12 months).

- Foreigners must complete the temporary residence registration process at the commune or ward police as per regulations.

The following individuals are not eligible for a temporary residence card in Vietnam:

- Currently under criminal investigation or serving as defendants in civil, economic, or labor disputes.

- Subject to an existing criminal sentence.

- Required to fulfill a civil or economic judgment.

- Required to comply with an administrative penalty, pay taxes, or fulfill other financial obligations.

Application documents

for a Vietnamese temporary residence card.

The application package for a temporary residence card for foreigners with a work permit or a work permit exemption in Vietnam includes:

  • A notarized copy of the Business Registration Certificate, or the Investment License, or the Operating License for Representative Offices, branches, etc., depending on the type of business.
  • Seal Registration Certificate or a document indicating that the company's seal information has been posted on the National Business Registration Portal.
  • A notarized copy of the foreign worker's valid work permit or work permit exemption with at least 12 months of remaining validity.
  • Registering the first-time seal and signature at the Immigration Department (Form NA16).
  • Official letter and application for a temporary residence card for foreigners (Form NA6).
  • Declaration form for applying for a temporary residence card for foreigners (Form NA8).
  • Letter of introduction for a Vietnamese employee to apply for a temporary residence card at the Immigration Department.
  • Original passport (with a minimum validity of 1 year, or 2 years if applying for a 2-year temporary residence card. The passport must contain a visa for work purposes, with an LĐ or DN code, obtained through sponsorship by the company).
  • A temporary residence registration certificate or a temporary residence book for foreigners, issued by the ward or commune police where the foreigner is temporarily residing in Vietnam (if applicable).
  • 02 photos measuring 2cm x 3cm.

Application documents for a temporary residence card for foreigners who are spouses of Vietnamese citizens:

  • A notarized copy of the Marriage Registration Certificate in Vietnam, or a consular legalized copy of the Marriage Certificate recognized in Vietnam for cases where the marriage was registered abroad.
  • Sponsorship and Temporary Residence Card Application for Foreigners (Form NA7)
  • Declaration form for applying for a temporary residence card for foreigners (Form NA8).
  • Original passport and visa (passport with at least 13 months validity and a Vietnam entry visa for the correct purpose).
  • 02 photos measuring 2cm x 3cm.
  • A notarized copy of the Vietnamese household registration book (hộ khẩu) of the Vietnamese spouse.
  • A notarized copy of the Vietnamese spouse's national identity card.

Application documents for a temporary residence card for foreigners whose father/mother is Vietnamese:

  • Birth certificate or other documents proving that the father or mother is currently a Vietnamese citizen.
  • Sponsorship and Temporary Residence Card Application for Foreigners (Form NA7)
  • Declaration form for applying for a temporary residence card for foreigners (Form NA8).
  • Original passport and visa (passport with at least 13 months validity and a Vietnam entry visa for the correct purpose).
  • 02 photos measuring 2cm x 3cm.
  • A notarized copy of the Vietnamese household registration book (hộ khẩu) of the Vietnamese parent.
  • A notarized copy of the national ID card of the Vietnamese parent.

Application documents for a temporary residence card for foreign investors in Vietnam:

  • A notarized copy of the Business Registration Certificate or Investment License, showing the specific and clear capital contribution of the foreign investor.
  • Seal Registration Certificate or a document indicating that the company's seal information has been posted on the National Business Registration Portal.
  • Registering the first-time seal and signature at the Immigration Department (Form NA16).
  • Official letter and application for a temporary residence card for foreigners (Form NA6).
  • Declaration form for applying for a temporary residence card for foreigners (Form NA8).
  • Letter of introduction for a Vietnamese employee to apply for a temporary residence card at the Immigration Department.
  • Original passport and visa (passport with at least 13 months validity and a Vietnam entry visa for the correct purpose).
  • Temporary residence registration certificate or a temporary residence book for foreigners, confirmed by the ward or commune police where the foreigner is temporarily residing in Vietnam.

Fees for issuing temporary residence cards for foreigners and the processing time.

According to Circular No. 219/2016/TT-BTC issued on November 10, 2016, by the Minister of Finance, the fees for issuing a temporary residence card are as follows:

  • Temporary residence cards valid from 1 to 2 years: 145 USD per card.
  • Temporary residence cards valid for more than 2 years up to 5 years: 155 USD per card.

The processing time for temporary residence cards for foreigners at the Immigration Department is 5 working days from the date of receiving complete and valid documents.
