According to the provisions of Article 13 of Decree 10/2020/ND-CP, cars transporting passengers must meet the following conditions:
· The vehicle must be owned or legally used (lease contract) by the transportation business unit. In case the car is owned by a member of the cooperative, there must be a contract between the member and the cooperative according to regulations;
· Fixed route cars must have a capacity of 9 seats or more with the following validity period: No more than 15 years from the year of manufacture for vehicles operating on routes with distances over 300km, not more than 20 years from the year of manufacture if they are cars operating on routes with distances of 300km or less;
· Bus vehicles have a shelf life of no more than 20 years from production; p>
· Taxi vehicles must have a capacity of less than 9 seats (including the driver) and have an expiry date of no more than 12 years from from year of manufacture; Do not trade in vehicles converted from a vehicle with 9 seats or more to a vehicle with less than 9 seats (including the driver) or a vehicle with the same size and style as a vehicle with 9 seats or more for transport by taxi; span>
· Tourist transport cars have a shelf life of no more than 15 years from the year of manufacture. Cars sold under contract have a shelf life as follows: Not more than 15 years from the year of manufacture for vehicles operating at a distance of over 300km, not more than 20 years from the year of manufacture for vehicles operating at a distance of over 300km. distance of 300km or less;
· Tourist transport cars and passenger transport business cars under contract with less than 9 seats ( including the driver) has an electronic contract with an expiry date of no more than 12 years from the year of manufacture;
· Cars with 9 seats or more (including the driver) must have cameras installed to ensure recording and storage images on the vehicle during traffic according to regulations.
>> Where to receive applications: After obtaining a business registration certificate or business household certificate, the enterprise submits the application to the Department of Transport. Load the province or city where the unit does business.
>> How to apply: Transport business units can submit applications directly to the Department of Transport of the province/city where their headquarters is located. or submit your application online via the province's public service page.
>> Time: Within 5 working days, the Provincial Department of Transport will issue a license to the unit if the application is valid. In case of need for adjustment or supplementation, the agency will notify you in writing.
According to Article 67 of the Traffic Law 2008, subjects allowed to operate transport business by car include businesses, cooperatives, and business households.
Thus, individuals and organizations that want to do business in this field are required to establish a company or registering business households and registering related professions, then Only then can you apply for a transport business license.

Note:
>> In addition to the above documents, for businesses and cooperatives, the following additional documents are required:
· List of vehicles attached with a copy of the vehicle registration (with a copy of the rental contract and translation contract services according to regulations in case the vehicle is owned by a member of the cooperative), environmental protection and technical safety certification;
· Equipment installation records used for communication between the operations center and vehicles registered to use the frequency radio communication with competent authorities (for businesses and cooperatives operating passenger transport by taxi);
· Decision on the establishment of the unit and regulations on tasks and functions of the management department, monitoring of things traffic safety conditions; registration of transport service quality (in case of enterprises or cooperatives doing passenger transport business on fixed routes, buses, taxis).
>> This transport operator must hold the title of director or deputy director; manager or deputy manager of the cooperative; Head of the transport operations department and must have professional qualifications according to regulations and continuously work at the transport unit for 3 years or more.
