Spa is a foreign term, so when used in Vietnam, it makes many people mistakenly think and misunderstand the legal aspects of this business activity. p>

According to the decision to promulgate Vietnam's economic sector system No. 27/2018/QD-TTg, specific regulations on spa activities are as follows:

+ Sauna, massage and similar health promotion services (except sports activities) include: Sauna, massage, sunbathing, non-surgical cosmetic services (belly fat removal, slim the body...) (Industry code: 9610)

+ Other personal service activities not yet classified in this group include: Hair cutting, hairdressing, hair washing. (Industry code: 9631)

Thus, based on the above legal basis, Spa is a beauty and skin care unit that does not use surgical methods, does not cause bleeding... (like a beauty salon or hospital) with or without massage

More specifically, legally there are 02 types of SPA: type with massage activityand type without massage activity

Clear identification of these two types will lead to a clearer identification of legal issues related to the operation and management of state agencies over SPA activities.

TYPES OF BUSINESS:

According to current regulations, the following business entities are entitled to do spa business:

1. Household business
2. Enterprises (Including private enterprises, partnerships, limited liability companies, and joint stock companies)

CONDITIONS FOR ESTABLISHMENT AND CONDITIONS FOR SPA OPERATION

To establish a Spa, you only need to meet the following conditions:

1. If you are an individual, you must be 18 years of age or older and not fall into the cases under Article 18 of the Enterprise Law.
2. If it is an organization, it must have legal status and does not fall into the cases under Article 18 of the Enterprise Law.
3. Have a clear business headquarters.

After being granted a business license (enterprise registration certificate, household business certificate), to do Spa business, you need to meet the following conditions:

If your Spa has massage activities, you must meet all the conditions according to the Regulations in Decree 96/2016/ ND-CP regulates security and order conditions for a number of conditional investment and business sectors, specifically, a certificate of satisfaction of security and order conditions must be issued before operations can begin.< /p>

If your Spa does not have massage activities then you can proceed with the operation after being granted a Business License.

Note, during the course of business, you must strictly comply with regulations on Fire Prevention and Fighting, these are prerequisite requirements.

I WANT to start a SPA business, HOW TO DO IT and where to start?

Step 1: Prepare documents to apply for a Business License:

1. If you are a business household, you need a copy of your personal identification card (citizen identification card, ID card) and office rental contract, other information to set up your records.
2. If it is other types of subjects, only a copy of personal identification (citizen identification card, identity card) and information to set up the dossier is needed.

Step 3: Carry out all tax, labor and insurance procedures according to regulations.

Step 4: Prepare conditions according to the Regulations in Decree 96/2016/ND-CP stipulating conditions on security and order for Some conditional business investment industries and professions (If your Spa has massage activities)

Step 5: Equip and meet fire prevention and fighting requirements.
