The operating term of the investment project is: (Article 44 of the Investment Law).

  • The operating term of an investment project outside an economic zone must not exceed 50 years.   • At the end of the investment project's operating term, if the investor wishes to continue implementing the investment project and meets the conditions prescribed by law, the operating term will be considered for extension. of investment projects but not exceeding the maximum term specified in Clauses 1 and 2 of this Article, except for the following investment projects:

a) Investment projects using outdated technology, potentially causing environmental pollution and resource-intensive;

b) Investment projects in cases where the investor must transfer assets without compensation to the Vietnamese State or Vietnamese party.

Your investment registration certificate states that the term is 10 years. The condition for project extension is that it is not a project in list a and b above and is considered and approved by the investment registration agency based on the following conditions (Article 27 of Decree 31/2021):

- In accordance with national planning, regional planning, provincial planning, urban planning and special administrative-economic unit planning (if any); consistent with urban development goals and orientations, housing development planning programs (for investment projects to build housing and urban areas);

- Meet the conditions for land allocation and land lease according to the provisions of land law (in case of request to extend land use).

A written request to extend the investment project's operating term; Investment registration certificate; Investor approval decision or documents of equivalent legal value; Certificate of land use rights or documents of equivalent legal value; Documents proving the investor's financial capacity include one of the following documents: the investor's 02 most recent financial statements; commitment to financial support from financial institutions; guarantee of the investor's financial capacity; Other documents proving the investor's financial capacity;
